No more ‘doble plaka’ under amended ‘Motorcycle Crime Prevention Act’

MANILA: A law revising Republic Act (RA) 11235 — also known as "Motorcycle Crime Prevention Act" — has been passed, which removes the need to place another license plate on two-wheeled vehicles.

    Senate Majority Leader Francis Tolentino today lauded the signing of the new law.

    "I leave the Senate full of gratitude seeing this landmark law finally being signed for millions of our kababayans who rely on their motorcycle daily," Tolentino said.

    Aside from removing the mandate on the additional license plate, RA 12209 reduces the excessive fines and penalties under RA 11235.

    Under RA 12209 Section 6, “without prejudice to criminal prosecution for violation of existing laws, the use of a stolen number plate or readable number plate in a motorcycle shall be punished with a fine of not more than P20,000.”

    Also, the new law requires a written agreement stating that the seller keeps ownership but allows the buyer to use the motorcycle until fully paid if the sale is through a dealership.

    Further, dealers now need to report possessions to the Land Transportation Office, which will revert the motorcycle registration to the former and mark the unit as under storage to prevent penalties.

    Those that sell vehicles — including those in the buy-and-sell business — must also submit an annual report on repossessed units.

    Dealers, original owners, or new owners who will fail to comply with the requirements will face a fine of not more than P5,000.

    Further, the law also forbids erasing, tampering with, or using a fake or altered motorcycle plate. Violators will face a six-months to two-year imprisonment; a fine of up to P10,000; or both.

    Anyone caught buying or selling such plates faces the same penalties.
